Brief Overview of the Faculty

Madonna University Nigeria was founded in 1999 as the Premier Private Catholic University in the West African Sub-Region, through the relentless effort of Rt. Rev. Fr. Prof. Emmanuel Mathew Paul Edeh. Motto and guiding principle of the University are: “Dignitas Scientiae et Moral” (Decency in Education and Morals).

Faculty of Law was one of the first Faculties to be established in the University. Its philosophy is built around the motto of the University, and its programme is designed to inculcate knowledge, decency and discipline in the graduates of the Faculty, and to ensure that they acquire a clear understanding of the laws and to use the knowledge so acquired to properly engineer the society in whichever sphere of life they may find themselves in future.

In line with the culture of the University, all students of the Faculty are resident on campus where discipline and morality are strictly maintained. This has endeared the Faculty to the public and has brought about an increased desire in parents to enroll their children into the Faculty and the University. However, as a result of the quota system policy of the Law School, and that of the National Universities Commission, student population in the Faculty of Law has been very much affected. Presently, the Faculty is domiciled on an expansive ultra modern edifice specifically structured for the purpose law education. The two storey edifice comprises three blocks on the ground floor that are interconnected, and two blocks on the first floor that are also interconnected. Block I of the ground floor has three wings, designated respectively as A, B and C. The Faculty has a moot court, Law Clinic, E-Library and a functional, well equipped Law library, and can boast of a team of well qualified lecturers.

PHILOSOPHY

All human activities, including social, economic, political, religious, etc, take place within the legal frame work within a state. The philosophy of law programme herein is designed to ensure that any graduate of law will be in possession of a clear understanding of the place and importance of law in the society. It is equally imperative that the student of law should have a broad general knowledge of and interaction with other disciplines in the society in his journey towards acquiring legal education.

Legal Education should include critical analysis and examination of prevailing social, economic and political systems of his community and secondly as an intellectual exercise aimed at studying and assessing the operation, efficiency and relevance of various rules of law the society. In designing this law programme or curriculum, much care has been taken to ensure that law will be taught as it exists at any given time and that the law student will be able to use law as a comfortable instrument to resolve various agitating social, economic, political and religious problems and conflict in the society.

The National Universities Commission in its publication. Approved minimum academic standards in law for all Nigerian universities” declared’ “The progamme, therefore seeks to introduce a student to the process of legal development and equip him with the basic tools of legal analysis or legal method”. It is inconceivable to produce a comprehensive programme to cover; and deal, with all the various and variegated legal fields. Hopefully on graduation, the law student will then be in a position to fend for himself.

OBJECTIVES

In view of the philosophy, the Faculty of Law aims at producing a law graduate with a level of education to serve as legal adviser to the governments of the day, their agencies, companies, business firms etc. As a law graduate, the student will qualify to be admitted into the Nigerian law school to train further and to qualify as a lawyer. He will then fit into judicial services, legal drafting and advising legislative and administrative functions, criminal prosecution, civil litigation, artitration, administration of a state, and etc.

SCOPE

The Faculty of Law offers a programme of undergraduate study leading to the degree of laws (LL.B) The duration of the programme is based on a five-point (5) years full time frame. The programme is based on a five-point system as recommended by the NUC and incorporated into this programme. The programme is for students with senior school certificate of Education (SSCE) Certificate, General Certificate of Education (GCE) Ordinary level or their equivalent. However, direct entry candidates will be permitted in the second year of the programme. Students’ progress throughout the programme is on a merit system. Students must pass most of all the courses in each year of study before proceeding to the next level. All field courses (if any) must be registered first before fresh courses.

Students who after graduating at the end of their course and wish to be called to the Nigerian Bar will have to proceed to the Nigerian Law School for a year’s professional course as required by Section 5 of the legal Education (Consolidation) Act 1976. The programme is designed to ensure that graduates of law will have a clear understanding of the place and importance of law in society. Because all human activities-social, economic political, etc. takes place within the legal framework, it is necessary that the student of law should have a broad general knowledge and exposure to other disciplines in the process of acquiring legal education. Legal education should therefore, act, first, as a stimulus to stir the student into critical analysis and examination of the prevailing social, economic and political systems of his community and secondly, as an intellectual exercise aimed at studying and assessing the operation, efficiency and relevance of various rules of law in society.

In the formulation of the curriculum presented in this Handbook, care has been taken to ensure that law will be taught as it exist at any given moment and that our students will be comparative in their approach to legal studies, bearing in mind that there are many systems of law- statutory law, common law- customary law and Islamic Law currently in operation. The programme seeks to introduce students to law, empower him with many principles of judicial process and legal development and equip him with basic tools of legal analysis or methodologies. The programme presents only a very dim light with which a prospective lawyer may see vaguely, the road maps that runs through a university and law school into “the temple of justice” where he will live all the days of his life. The programme is not designed to make him an expert in any field of law, but to enable him see in a caliginous light what openings are available to him as a student. He can then make a more sensible choice where to move in and pitch his tent in the legal field; there he would specialize by acquiring the necessary and relevant tools, skills, tricks and experience, which will guide him successfully through his life’s journey with the law.

Emphasis shall therefore be laid on the development of the following:

  • A sound University education in law with sound catholic Christian knowledge and practice
  • Understanding of the role of law in society
  • Knowledge of institutions, such as parliaments, courts and other public organizations
  • The capacity to analyse legal materials
  • The capacity to listen, argue and write effectively (communication skills)
  • Research skills (searching the law- the capacity to find the relevant law and information as needed)
  • A good grasp of current information technology
  • Knowledgeable in other areas of human endeavours, like psychology, political Science, economic, etc. to appreciate the role of law in the society
  • Knowledge of law to enable tentative diagnosis of legal problems
  • Basic knowledge in drafting legal documents
  • Awareness of the importance of the legal system as a whole.
